Terms of Service

1. Agreement to terms

By accessing or using The Smart Operator website, purchasing the AI Tools Assessment, or using any related services (collectively, the "Service") operated by Crafted Labs Holdings Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Service description

The AI Tools Assessment is a productized 1:1 advisory engagement that includes:

• A 45-minute recorded discovery call with Bryan Smith.
• A custom written report with 3–7 specific AI tool recommendations, a priority matrix, setup instructions, and a 4-day quick-start plan.
• A 30-minute walkthrough call to review the report.

The Service provides recommendations and guidance. Outcomes depend on your business, your effort, and your implementation. The 5-hour-back guarantee in Section 4 is the only outcome we warrant.

3. Booking and scheduling

After purchase, you will receive scheduling links to book the discovery and walkthrough calls. We aim to deliver the custom report within 5 business days of the discovery call. The total engagement is typically completed within 1–2 weeks. Excessive delays in scheduling may extend that window.

4. Payments, billing, and the 5-hour-back guarantee

• Payment: The AI Tools Assessment is a one-time payment of $799 USD, processed securely through Stripe. By purchasing, you agree to Stripe's terms of service.
• 5-hour-back guarantee: If you implement the recommendations in your custom report and have not recovered at least 5 hours per week within 30 days of receiving the report, email us and we will refund the full $799. No hoops, no questions.
• Refund window: Refund requests must be submitted within 30 days of report delivery.
• Implementation engagements: If you choose to work with us on implementation after the assessment, those engagements are scoped and priced separately and are governed by their own statement of work.

5. Intellectual property

Your custom report, recordings, and any frameworks or templates we provide are licensed to you for use in your own business. You may not:

• Redistribute, resell, or share your report or recordings publicly or with anyone outside your business.
• Use the materials to create a competing assessment, course, or product.
• Remove copyright or proprietary notices from any materials.

We retain ownership of all underlying methods, frameworks, templates, and content, and may use anonymized insights from our work with you to improve the Service.

6. Confidentiality

Information you share during the discovery call and through the engagement is treated as confidential. We will not share specifics of your business with third parties except as required to deliver the Service (for example, scheduling and payment processors) or as required by law. Anonymized, aggregated insights may be used in marketing.

7. Third-party tools and services

The recommendations in your report will reference third-party tools (for example, ChatGPT, Claude, Zapier, Make, and similar services). We are not responsible for the availability, accuracy, pricing, or performance of any third-party tool. Any costs associated with third-party tools are your responsibility and are separate from the assessment fee.

8. Disclaimer of warranties

Except for the 5-hour-back guarantee in Section 4, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that:

• The Service will be uninterrupted, error-free, or available at all times.
• The website will be accurate, complete, or current at all times.
• Any specific business outcome beyond the 5-hour-back guarantee will be achieved.
• Third-party tools referenced in the report will remain available or function as described.

9. Limitation of liability

To the maximum extent permitted by law, Crafted Labs Holdings Inc. and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including lost profits, lost data, business interruption, or decisions made based on the report.

Our total liability for any claim arising from the Service shall not exceed the amount you paid for the assessment.

10. Acceptable use

You agree not to:

• Use the Service for any illegal purpose.
• Attempt to gain unauthorized access to any part of the Service.
• Interfere with or disrupt the Service or its infrastructure.
• Impersonate any person or misrepresent your affiliation with any entity.

11. Termination

We may decline or terminate an engagement at any time for abusive behavior, illegal conduct, payment failure, or any reason we deem necessary to protect the Service. If we terminate before the report is delivered for reasons other than your conduct, we will refund the assessment fee.

12. Governing law

These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles.

13. Dispute resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in Spokane County, Washington, under the rules of the American Arbitration Association. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Changes to terms

We may update these Terms from time to time. Material changes will be posted on this page with a new "Last updated" date. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
